Terms of Service

By accessing or using the services provided by Zynexa Creators (hereinafter referred to as "Company", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

These terms apply to all clients, visitors, and users who access our website or purchase our services.

Zynexa Creators offers the following services:

• Website Design & Development: Custom websites (Landing pages, Business websites, E-commerce stores)
• SEO & Monetization: SEO optimization, AdSense approval, Adsterra/Monetag setup
• AI Services: AI logo design, AI video generation, AI music generation
• Social Media Services: Facebook ads setup, page creation, TikTok accounts, social media growth
• Maintenance & Support: Website maintenance, updates, backups, security monitoring

All services are provided as described on our Pricing Page and Home Page.

3.1 Payment Structure

3.2 Accepted Payment Methods

• Bank Transfer: All major Pakistani banks
• Easypaisa: Mobile account transfer
• JazzCash: Mobile account transfer
• PayPal: For international clients (additional fees may apply)
• Wise/Payoneer: For international transfers

3.3 Late Payments

If final payment is not received within 7 days after website completion, a 5% late fee will be applied per week. After 30 days, we reserve the right to take down the website until payment is received.

3.4 Currency

All prices are listed in Pakistani Rupees (PKR) for local clients and US Dollars (USD) for international clients. Domain registration and hosting charges are separate.

4.1 Advance Payment

The 50% advance payment is non-refundable once work has begun. This covers initial consultation, design mockups, and resource allocation.

4.2 Refund Eligibility

• If we fail to start work within 7 days of receiving advance payment → 100% refund of advance
• If we miss the agreed delivery deadline by more than 15 days (without valid reason) → 50% refund of total amount
• If the final website is completely different from what was agreed (and we refuse to fix it) → Partial refund based on work done

4.3 No Refund Scenarios

• After website completion and approval
• If you change your mind after work has started
• If you provide incorrect or incomplete requirements
• For domain registration fees (once purchased)
• For hosting services (once activated)
• For third-party services

Note: Delivery time starts after we receive:

• ✓ 50% advance payment
• ✓ All required content (text, images, logos)
• ✓ Clear requirements and approval of design mockup

Delays caused by client (late content, revisions, feedback) will extend the timeline accordingly.

What counts as a revision? Minor changes like text edits, color adjustments, image replacements, layout tweaks.

What is NOT a revision? Complete redesign, new pages, new features, functionality changes, additional integrations.

Major changes require a separate quotation.

7.1 Hosting Services

We provide premium hosting for 5,000 PKR per year. This includes:

• ✓ Daily automatic backups
• ✓ Free SSL certificate
• ✓ Security monitoring and updates
• ✓ 24/7 technical support

Note: You can also use your own hosting provider if you prefer. We will provide you with all necessary files to upload to your hosting.

7.2 Domain Registration

Domain registration is NOT included in our plans. We provide a free subdomain (yourbusiness.zynexacreators.com) or you can purchase your own domain. Domain prices vary by extension:

• .com, .pk, .net → 2,000 - 3,500 PKR/year
• We can help you purchase and connect your domain (no extra service charge)
• Domain renewals are your responsibility

7.3 Hosting Termination

We reserve the right to terminate hosting services if:

• Website violates Pakistani law or our policies
• Website is used for illegal activities (spam, hacking, piracy)
• Client is abusive to our team
• Client fails to pay for hosting renewal

You will receive 30 days notice before termination, and you can take your website files with you.

8.1 Ownership

After final payment is received, you own the complete source code of your website. We transfer all rights to you. You can modify, sell, or transfer the website as you wish.

8.2 Our Rights

We retain the right to:

• Display your website in our portfolio (unless you request otherwise)
• Use code snippets for future projects (generic code, not your specific content)
• Retain a small credit link in the footer (can be removed for 2,000 PKR one-time fee)

8.3 Third-Party Assets

Any images, fonts, icons, or plugins provided by third parties are subject to their respective licenses. We use only royalty-free or properly licensed assets.

As a client, you agree to:

• Provide accurate and complete information about your requirements
• Provide content (text, images, logos) within agreed timelines
• Respond to our feedback requests promptly (at least within 3 business days)
• Ensure you have the rights to use any content you provide
• Not use the website for illegal activities or content that violates Pakistani law
• Not resell our services without written permission

Failure to meet these responsibilities may result in project delays or termination.

We respect your privacy and will not share your:

• Business ideas or strategies
• Login credentials or sensitive data
• Customer information
• Proprietary content

All information shared during the project will be kept confidential and used only for delivering your website.

To the maximum extent permitted by law, Zynexa Creators shall not be liable for:

• Any indirect, incidental, or consequential damages (including lost profits, data loss, or business interruption)
• Issues caused by third-party services (hosting providers, domain registrars, payment gateways)
• Loss or corruption of data due to client negligence (not maintaining backups)
• Security breaches that occur after website delivery (we take maximum precautions, but cannot guarantee 100%)

Our total liability for any claim shall not exceed the amount paid by you for the specific service in question.

Services are provided on an "as is" and "as available" basis. While we strive for excellence, we do not warrant that:

• The website will meet all your expectations (we will try our best though!)
• Services will be uninterrupted, error-free, or completely secure
• Any errors will be corrected immediately
• The website will generate specific revenue or traffic (results vary)

However, we stand behind our work. If something is wrong, we will fix it for free within the first 30 days after delivery.

13.1 By Client

You may terminate the project at any time. You will receive all work completed up to that point. Advance payment is non-refundable.

13.2 By Us

We may terminate services if:

• Client violates any term of this agreement
• Client is abusive, threatening, or harassing to our team
• Client requests work that is illegal or unethical
• Client fails to pay for services

In case of termination by us (without client fault), you will receive a pro-rated refund for uncompleted work.

These terms shall be governed by and construed in accordance with the laws of Pakistan. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts in Multan, Pakistan.

Before filing any legal action, both parties agree to attempt good-faith negotiation for 30 days.

We reserve the right to update these terms at any time. Changes will be posted on this page with an updated revision date. For existing clients, we will notify you via email or WhatsApp of any material changes. Your continued use of our services constitutes acceptance of the new terms.

These terms constitute the entire agreement between you and Zynexa Creators. Any previous agreements, whether written or oral, are superseded. If any provision is found to be unenforceable, the remaining provisions shall remain in effect.
